Arrest in Reckless Discharge of a Firearm by Armed Habitual

On Wednesday August 21, 2024, at 12:50 PM, St. Charles Police officers were dispatched to the 1500 block of E. Main Street for the report of shots fired. The caller advised that a male and two females were walking in that area between the Super 8 Hotel and an adjacent strip mall. One of the females was holding a small child. The caller witnessed what appeared to be a negligent/accidental discharge of a handgun by the male subject. Officers arrived within 3 minutes, located the group, and observed a handgun in the pocket of the male subject as they approached. The male subject was safely taken into custody immediately upon the arrival of police.

Fortunately, no one was struck by the gunshot, and no one was injured as a result of this incident. The male subject was identified as: Kyle Burnett, age 36, of Aurora, Illinois.

A subsequent investigation was conducted by officers and detectives. After reviewing the information learned in that investigation with the Kane County State’s Attorney’s Office, Burnett was charged with the following offenses:

1. Armed Habitual Criminal Class X Felony

2. Unlawful Possession of a Firearm by A Convicted Felon Class 2 Felony

3. Unlawful Possession of a Firearm by A Felon While on Parole Class 2 Felony

4. Unlawful Possession of a Firearm by A Street Gang Member Class 2 Felony

5. Aggravated Unlawful Use of a Weapon – No FOID Class 2 Felony

6. Aggravated Unlawful Use of a Weapon – No CCL Class 2 Felony

7. Reckless Discharge of a Weapon Class 4 Felony

8. Endangering the Life or Health of a Child Class A MisdemeanorBurnett was turned over to the custody of the Kane County Jail pending a pre-trial detention hearing to be held Thursday August 22,2024. The charges against Burnett are not proof of guilt. He is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove guilt beyond a reasonable doubt.
